Terms & Conditions

In these terms and conditions wherever the following words appear they will always have these meanings:


 “C.W.T.” means: Customised Walking Trips.   


"Client" means you, the person who agrees to become involved in the trip, or any person on whose behalf it is agree to include in the trip, and who is listed on the Confirmation Invoice/e-mail/letter. The Client, or any member of a party with the Client, must be at least 18 years of age and must be authorised to make the booking on the basis of these Terms and Conditions by all the persons named in the booking. You are responsible for making all payments due to us, C.W.T.  


“trip” refers to any walking trip.

 

You will be joining us on the Portuguese Camino/Customised Walking Trips/Pilgrim Customised trips Ireland at your own personal safety at all times, Despite every precaution will be taken to insure of you personal safety and satisfaction on each trip, accidents do/will happen so it is up to each individual to be mindful of themselves while on such trips and to make sure of their personal safety and well-being at all times.

By coming on such trips you are exposing yourself to the possibility of injury and while we place paramount importance on your safety and take every measure to insure it, we cannot be held responsible to any such negligence on your part while on your requested trip. Self Duty of Care is paramount while on any requested trip that you have chosen


Luggage transfers and safety deposit boxes

Because there is an offer of transfer of luggage (Daily) in some trips,and luggage will be left unattended by their personal owners, we cannot take responsibility of any valuables a person (s) may bring with them on any such trips. All valuable contents are to be kept in person at all times throughout the duration of a trip.


Accommodation selected by C.W.T on this trip is based on quality and particularly on hotel quality. Where any accommodation has a safe in their room, individuals must avail of it or in the event of none being available, they shall avail of such safe keeping arrangements provided by the accommodation  provider.   It is the total responsibility of each individual to make sure that their valuables are safe at all time as C.W.T will not be responsible for loss of same.



Personal Property

Some trips will require the transfer of the baggage of the Client from one overnight accommodation to the next.  In this event the Client shall ensure that his/her valuables, i.e. jewellery,  passport, money, electronic goods, etc., shall bein their possession and shall be their sole responsibility and they shall be responsible for their transportation. C.W.T. shall use their best endevours to ensure that transfered baggage is be kept securely in the accomodation that they are transfered to, but clients must understand that they will be left unattended and C.W.T. shall not be responsible for any loss sustained by the Client where valuables are left in unguarded situations, in the event of there being any loss of such valuables.


Behaviour

As this will be an autonomous group of individuals, personal behaviour on this trip is vital for the well-being of the group as a whole. Persistent bad behaviour or dis-respect to any individual in this group by a client or clients, will not be tolerated and immediate exclusion from the group and this trip, as set out below, will follow. In the event of this happening we at C.W.T. will not be responsible in anyway for additional costs that may be inccurred to any such client in the event of this happening.


We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any person in authority, you or any member of your party persistently behaves in such a way as to cause or be likely to cause damage to property, C.W.T. are entitled, without prior notice, to terminate the trip of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the trip with immediate effect. We will have no further responsibility toward such person(s) including any travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination. Where any accommodation has a safe in their room, individuals must avail of it or in the event of none being available, they shall avail of such safe keeping arrangements provided by the accommodation  provider.   It is the ton such circumstanceswhere property is damaged the Client, hereby agrees to indemnify C.W.T. against any claim (including legal costs) made against C.W.T. in relation to the occurrence of such incidents.


Eligible Participation of individuals on this trip. Minimum Age

Even though C.W.T are ''family friendly'' and invites families on this trip, any Client who is under 18 years at the commencement of the trip, (a minor), must be accompanied by a Parent or Appointed Guardian (over 18 years of age on date of departure) who will take full responsibility for this minor(s) for the duration of this trip. A minor will not be permitted to travel in circumstances where the minor is not accompanied by a Parent or Appointed Guardian (over 18 years of age on date of departure), and in such circumstances 100% cancellation charges will apply. C.W.T will not take responsibility in anyway for the well being and behaviour of any minor for the duration of this trip.  We refer you to the previous paragraph in relation to Behaviour.


Physical Health and Ability of Individuals.

We at C.W.T will do its utmost to ensure that all individual(s) will be informed as to how to  prepare for this trip by way of pre-suggested recommendations before you depart.  These suggested recommendations will be by way of information/advise on training walks, footwear and clothing for the trip. However it is the responsibility of each individual to be self aware of their physical state given the trip you are about to undertake.  In the event you have some concerns about your physical state of health, in addition to consulting your medical adviser in relation to them, please state this before booking this trip. C.W.T cannot take responsibility for the consequences of not being prepared to participate or in the event of old injuries re-occurring while on this trip.


Fitness and Ability

It is imperative for everyone’s sake that you are fit and healthy and able to participate in all included elements of you chosen trip. Please ensure you have read the trip literature and you have achieved a level of fitness sufficient to complete the trip.


Proper footwear/Clothing.

It is the responsibility of each individual to have the proper footwear/clothing and essentials in undertaking this trip. In the event that C.W.T deems anyone's individual gear unsuitable for such a journey, in the interest of health/safety for each individual, C.W.T have the right to express these views and to require that either the individual gets the appropriate gear recommended or automatically lose their place on this trip.  In the event that no action is taken to rectify this problem by any such individual C.W.T will not be responsible in anyway for additional cost to any individual in the event of this happening.


Travel insurance is compulsory on this trip and it is up to each individual to make sure that they are fully covered in all areas concerning this trip. In the event of injuries inflicted upon ones self and you are not covered under your travel insurance, you will be responsible for any additional costs to yourself as C.W.T will not be responsible in anyway for these additional charges or costs.


Insurance covering you for the activities on your itinerary is mandatory for all Clients on a trip.  It would be advisable to consult your medical adviser in relation to any pre-existing medical conditions you might have and receive their consent to participate in the trip you are going to undertake. We advise you to obtain travel insurance before you book your trip,  so that cover will be in place in the event of unforeseen circumstances, such as illness or injury, that might result in you not being able to take part in your trip.


It is a condition of all contracts for participation in a trip that the Client is covered by insurance commenced in advance of the payment of any monies whatsoever on the trip.  You are strongly recommended to obtain insurance before booking the trip.  


Medical costs abroad: It is essential that you have adequate medical insurance and that you carry a copy of your insurance policy with you. If you have a medical bill whilst on trip it is common practice to pay the entire bill in the location.


Booking Conditions


Clients booking will be deemed to have agreed to the following conditions:

a) they have read and accepted our Terms and Conditions and general information pages, contained on our website for the particular trip, other related documents posted or emailed to the Client, as they set out our respective rights and obligations.

b) they appreciate that risks are involved in a walking trip.

c) they do not suffer from any pre-existing medical condition which may prevent them from actively participating in the trip, particularly old conditions that may be reactivated by the trip.


By asking us to confirm your booking, you agree that you understand these terms and conditions that apply to this trip and that you have read these booking conditions and agree with and have acted upon them where relevant.  


Booking Deposits

Booking Deposits are to be paid 6 weeks before the commencement date of the trip and are non refundable.  However in the event of a late cancellation where a booking has been made there may be cancellation costs and these will be deducted from monies paid.  In the event of an emergency caused by a medical event or a close family berevment, consideration for a refund will be given to each particular situation.  In the making of a refund in such circumstances, it does not set a precedent in respect of making any further or future refunds.


Balance due 2 weeks before the date of commencement of the trip.


Deposit payment

We require a deposit to confirm a booking. Where travel is within 3 weeks of booking full payment is required.


Confirmation of booking

Once a booking has been confirmed a confirmation e-mail/letter will be sent to you along with additional trip information.


Final payment

Your final invoice will be sent to you 4 weeks before departure. Payment of the balance is due no later than 2 weeks prior to departure.  If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled, unless prior arrangements have been made.


Making payment

Deposit and full Payment can be made by cheque, bank draft or bank transfer. We will send an invoice to your email/postal address. Cheques and Bank Drafts are to be made payable to Customised Walking Trips. For bank transfers we will supply you with our bank details, please ensure you use your name as the payer reference.  Cheques and Bank Drafts will not be accepted less than 1 week before the departure date, bank transfers will only be accepted in this circumstances


Booking check-list – Please ensure you are aware of the following important issues before booking an trip:

Passports

All Clients must have a passport valid for at least 6 months from the date the trip ends.


Visas

Clients must obtain tourist/entry visas for the destination if required.


Deposit requirement

You are required to pay a non-refundable deposit of EUR200 per person per trip for your booking to be confirmed. If your booking is made within 2 weeks of the departure date then the full amount is payable at the time of booking.  Please note that different deposits amounts may be required for selected walking trips.


Inclusions

The price of your trip includes:


    All accommodation as listed in the Itinerary Information

    All transport listed in the Itinerary Information

    Sightseeing and meals as listed in the Itinerary Information

    The services of C.W.T. as described

    Transfer of baggage (where specified)

     Airport transfers (additional charges will apply where not included in overall package)


Exclusions

The price of your trip does not include:


    International or internal flights

    Local Tourist Fees

    Meals other than those specified in the trip Information

    Visa and passport fees

    Travel insurance

    Optional activities and all personal expenses


Payment and Cancellation Charges

The trip must be paid for in full 2 weeks before the scheduled date of the commencement of the trip. If the proposed trip is booked within 2 weeks of the scheduled departure date payment will be in cash.  Any balance outstanding for any services added to the booking will be paid in cash.   If the full payment has not been settled on the balance due date of the trip, C.W.T. shall have the option to cancel the trip. If C.W.T. exercises that option or if the Client cancels the trip(which cancellation must be notified in writing to C.W.T.) cancellation charges are payable by you.


Cancellation by you the Client

Should you or any member of your party need to cancel all or part of your chosen trip once it has been confirmed, the party leader must immediately advise us in writing. Your notice of cancellation will only be effective when it is received in writing by us.  If you or any member of your party cancel the proposed trip, the following charges shall be payable by you.


As we incur costs from the time we confirm your booking and may be unable to re-sell your trip, the following cancellation charges will be payable. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total cost payable by the client(s) cancelling excluding any amendment/cancellation charges which have already been incurred. Amendment/cancellation charges are not refundable in the event of the client(s) to whom they apply cancelling.


Re-selling of trip by an individual.

If for any reason an individual cannot go on any requested trip after paying the full amount due. This individual can re-sell their place to another person privately as long as there is no flight charges involved. Additional charges will apply for change of names on flight tickets.



 All cancellation charges apply to each person covered by a booking.


Clients with medical conditions

It shall be the Clients sole responsibility and in their best interests to advise C.W.T. any of any relevant medical condition or disability of theirs or a member of their party which may be relevant.  C.W.T. may then decide at its sole discretion whether the person is capable of undertaking the trip. C.W.T. cannot accept liability for the unsuitability of any trip where the Client fails to inform C.W.T. of the medical condition or disability of theirs or of a member of their party which may be relevant.  C.W.T. reserves the right to decline to provide a trip in such circumstances.


Special requests

Special requests are limited to preferences in relation to:

ground floor accommodation,

special dietry requirements,

twin/double room accomodation

and shall be communicated by each individual in writing to C.W.T. at the time of making the booking, C.W.T. shall use reasonable endeavours to fulfil such requests. The granting of such requests is the sole responsibility of the party supplying the subject of the special request. No liability shall attach to C.W.T. for failure to comply with a special request and such requests do not form part of the contract.


Alteration/Cancellation by C.W.T.

Without prejudice to your statutory rights:


C.W.T. reserves the right to alter, change, curtail or cancel any trip before departure.  In the event of a prior cancellation by C.W.T. on any such trips, total monies paid to C.W.T.will be returned in full.  No other claims will be entertained or paid by C.W.T. in the event of such a cancellation.


If as a consequence of “force majeure” (as hereinafter defined in subparagraph (f) of this clause), C.W.T. is obliged to curtail, alter, extend or cancel an trip, the Client shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of the said curtailment, alteration or extesion. Very rarely, we may be forced, due to force majeure to change or terminate your trip before the scheduled commencement or end of the trip. This is extremely unlikely, but if this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our suppliers), pay you any compensation or meet any costs or expenses you incur as a result.


In these Terms and Conditions, the term “force majeure” means unusual and unforeseeable circumstances beyond the control of C.W.T., or other supplier of services, the consequences of which could not have been avoided even if all due care had been exercised or an event which C.W.T., or the supplier of services, even with all due care, could not foresee or forestall. It includes Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with an trip, riots, acts of war, terrorism, civil commotion exercise of legislative, municipal, military or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any service supplier connected with an trip, fraud perpetrated against C.W.T. or any other reason beyond the control of C.W.T..


C.W.T. requires a specific minimum number of bookings to operate a specific trip. C.W.T.’s obligation to provide that trip shall be contingent upon C.W.T. receiving and maintaining that number of bookings. In the event that C.W.T. does not receive the minimum number of bookings or having received such a minimum number, has that number reduced by reason of cancellation or transfers by Clients or otherwise, C.W.T. shall be entitled to cancel or curtail the relevant trip up to 4 weeks prior to the departure date and the Client shall not be entitled to make a claim for loss arising as a consequence of cancellation or curtailment in these circumstances. C.W.T. shall notify the Client in writing within 7 days of any cancellation or curtailment necessitated by the foregoing circumstances.


If prior to the time of departure there is a cancellation, or a major change, such as a change of itinerary on the trip, or a change of accommodation to a lower rating, C.W.T. shall, if practicable offer an alternative comparable itinerary of at least similar standard or shall refund the Client all monies paid.  Unless, within 7 days of issue of the offer of an alternative trip, it is accepted by the Client in writing, C.W.T. shall assume that the Client has declined such offer and the Client shall only be entitled to return of the payment made.


Price Variation

Whilst we endeavour to maintain prices, we must reserve the right to increase or decrease them at any time after publication for any reason (including because our costs may have changed since those prices were calculated). We also have the right to correct errors. The current prices of your trip will be made known to you on enquiry.   They are also shown on our website and are available by contacting us. Please ensure you have checked the price of any trip you are interested in before making your booking. Once the price of your chosen trip has been confirmed at the time of booking, then subject to the correction of errors, we will only increase or decrease the price in the circumstances outlined below.


Price increases or decreases after booking will be passed on by way of a surcharge or refund. A surcharge or refund (as applicable) will be payable, subject to the conditions set out in this clause, in the event of any change in our transportation costs or in dues, taxes or fees payable for services. In a case where only some of the Clients booked cancel,C.W.T. may, in addition to levying cancellation charges, adjust the price of the trip for the remaining Clients.


Even in the above cases, only if the amount of any increase in our costs exceeds 2% of the total cost of your trip(excluding amendment charges) will we levy a surcharge. If any surcharge is greater than 10% of the cost of your trip(excluding any amendment charges), you will be entitled to cancel your booking and receive a refund of your monies (except for any amendment charges) or alternatively purchase another trip from us.


You have 14 days from the notification date to tell us if you want to pay the surcharge or, if applicable, cancel your booking and obtain a full refund of your monies. If you do not tell us that you wish to choose either of these options within this period of time, we are entitled to assume that you wish to pay the surcharge. Any surcharge must be paid with the balance of the cost of the trip or within 14 days of the notification whichever is the later. A refund will only be payable if the decrease in our costs exceeds 2% of the total cost of your trip as set out above. Where a refund is due, we will pay you the full amount of the decrease in our costs.


Clients Responsibilities

Each Client shall check the documentation immediately it is furnished to him. If the Client considers any document is incorrect or has any query in relation to the contents he shall forthwith notify C.W.T. of his concern and C.W.T. shall respond as soon as possible.


The Client is solely responsible for ensuring that he presents himself at the meeting point designated for the commencement of the trip.    If the Client arrives after the designated time stipulated in the documentation provided to the Client, C.W.T. shall not be obliged to the Client and shall be entitled to treat the trip as cancelled by the Client.  Any variation from this subsection of this condition is strictly at the sole discretion of C.W.T..


The Client hereby agrees that he shall abide by all instructions or directions given by C.W.T. or a member of C.W.T.'s staff or the staff of any vehicle used in connection with the trip and hereby agrees to indemnify C.W.T. against any loss or injury suffered or incurred by any other person as a consequence of the Client's failure to act in accordance with any such direction or instruction.


Our trips are run by  C.W.T.  The decision of C.W.T. is final on all matters likely to affect the safety or well-being of any Client or staff member participating in the trip.


It is also the sole responsibility of the Client to ensure that he is in possession of all identity documentation i.e. passports, visas (where relevant) and vaccination certificates required for the whole of their trip and that same are in order. The Client hereby agrees to indemnify C.W.T. for any costs incurred by C.W.T. as a consequence of the Client being denied transportation either as a consequence of the Client failing to have their identity documentation and visas (where relevant)or same not being in order.  


Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.


Liability

C.W.T. shall not be liable for any damage caused to the Client by the failure to perform the contract or the improper performance of the contract where the failure or the improper performance is due neither to any fault of C.W.T. or that of another supplier of services because:


(i) the failures which occur in the performance of the contract are attributable to the Client;


(ii) such failures are attributable to a third party unconnected with the provision of the services contracted for, and are unforeseen or unavoidable;


(iii) such failures are due to (a) unusual and unforeseeable circumstances beyond the control of C.W.T. or other supplier of services, the consequences of which could not have been avoided even if all due care had been exercised; or (b) an event whichC.W.T., or the supplier of the services, even with all due care, could not foresee or forestall.


C.W.T. obligations, and those of our suppliers providing any service or facility included in your trip, are to take reasonable skill and care to arrange for the provision of such services and facilities and, where we or our supplier is actually providing the service or facility, to provide them and to do so with reasonable skill and care. Standards of, for example, safety, hygiene and quality vary throughout the transport and destinations that your holiday may involve. Sometimes these standards will be lower than those which would be expected to be found in your own country. The services and facilities included in your holiday will be deemed to be provided with reasonable skill and care if they comply with any local regulations which apply, or, if there are no applicable local regulations, if they are reasonable when compared to the local standards and customs.


Excursions, Activities and Website Information

The information contained on our website is correct to the best of our knowledge at the time the website went live. We may provide you with information (on our website and/or when you are on trip) about activities and excursions which are available in the area you are visiting. We have no involvement in any such activities or excursions which are neither run, supervised nor controlled in any way by us. They are provided by local operators or other third parties who are entirely independent of us. They do not form any part of your contract with us even where we suggest particular operators/other third parties and/or assist you in booking such activities or excursions in any way. We cannot accept any liability on any basis in relation to such activities or excursions. We cannot guarantee accuracy at all times of information given in relation to such activities or excursions or about the area you are visiting generally (except where this concerns the services which will form part of your contract) or that any particular excursion or trip which does not form part of our contract will take place as these services are not under our control.


Late Availability

Close to departure date, C.W.T. may occasionally offer late availability of a trip where you accept the arrangements made for accommodation on arrival. If you have specific trip requirements it is advisable to inform us of them immediately to ensure any of your specific requests have the best possibility of being met. However given that the client has availed of a late availability trip it may not be possible to facilitate such specific requests.  Late availability of an trip may be subject to conditions other than those shown on this website and consequently one should check when booking.
